Nationality by residence is one of the most common ways to achieve this. Imagine being able to enjoy all the rights and opportunities that Spain has to offer, from voting in elections to accessing a dynamic labour market and quality healthcare.
What does residency consist of? Basically, this option allows you to apply for Spanish nationality if you have lived legally in Spain for a certain period of time.
This period varies depending on your country of origin and other circumstances:
- 10 years: This is the general period.
- 5 years: For people who have obtained refugee status.
- 2 years: For nationals of Latin American countries, Andorra, the Philippines, Equatorial Guinea, Portugal or people of Sephardic origin.
- 1 year: Special cases such as those born in Spanish territory, persons who did not exercise their right to opt for Spanish nationality, those who have been subject to the parental authority of a Spanish national, widows/widowers of Spanish nationals, or persons born outside Spain to a Spanish father or mother (also born outside Spain) who are Spanish.
Key requirements:
- Legal and continuous residence: You must prove that you have resided in Spain legally (with your residence card in order) and continuously (without prolonged absences).
- Good Civic Conduct: You are expected to behave well and respect Spanish laws.
- Integration into Spanish Society: You must demonstrate a sufficient degree of integration into Spanish society. This is assessed through two tests:
- CCSE Test: Demonstrate basic knowledge of the Spanish Constitution and Spanish social and cultural reality.
- DELE A2 exam (or higher): Certifies a basic level of Spanish. (Exempt: nationals of countries where Spanish is the official language).
How to apply The process is carried out online via the Ministry of Justice platform. You will need to prepare a series of documents, such as your birth certificate, residence card, criminal record certificate, and CCSE and DELE test certificates (if applicable).
